What looks like bias is usually one of three things: a judge who is brusque with everyone, a ruling that went against you for reasons nobody explained, or a local legal community where everyone genuinely does know everyone. Actual disqualifying bias is rare and difficult to prove, and motions to recuse are decided in the first instance by the judge you are asking to step down, so they are high-risk and rarely successful. The more useful response is almost always to strengthen your presentation and your record rather than to attack the decision-maker.

Is family court biased against men or women?

Both claims are made with equal conviction, which is itself informative. Statutory maternal preference has been removed, and shared parenting is now the common starting point in most states. Individual judges do carry biases, and outcomes can look patterned in a given courtroom. But most results that feel like gender bias turn on caregiving history, documentation, and presentation, which are things you can control, unlike a judge’s disposition.

When lawyers and judges know each other

In most jurisdictions the family bar is small: the attorneys and judges appear together constantly, go to the same events, and are often friendly. That is normal rather than corrupt, and it is not evidence of a scandal. It can even work in your favor, because an attorney with a good reputation before a judge carries credibility.

The legitimate concern is different: whether your attorney is pulling punches to preserve a relationship, or whether both attorneys are content to let a case run long. If you suspect that, ask directly what they intend to do about a specific problem and why. Vagueness in response is more telling than the friendship itself. Our answer on changing attorneys covers what to do next.

Recusal: a reality check

Grounds are narrow: a personal or financial interest, a relationship with a party, or demonstrated prejudice, rather than a series of rulings you disagree with. The motion typically goes first to the judge in question. If it fails, and it usually does, you continue before a judge who now knows you tried to remove them. Do not file one without your attorney’s clear advice to do so.

What to do instead

Ensure your evidence and objections are properly before the court, because an appeal depends entirely on the record. Comply with everything, stay unemotional in filings, and be the party the judge never has to manage. If a judge’s rulings genuinely misapply the law, that is an appellate question, not a recusal one. See appeals.

Telling the difference between a bad draw and a fixable presentation problem is where an experienced outside view helps, and it is what BTGO’s coaching offers alongside your attorney’s tactical judgment.

Frequently asked questions

Is family court biased against men or against women?

Both are commonly claimed. Statutory gender preferences have been removed and shared parenting is the usual starting point. Most outcomes that feel like bias turn on caregiving history, documentation, and presentation.

What do I do if the judge is biased against me?

Strengthen your record and presentation rather than attacking the judge. Ensure evidence and objections are properly on the record, comply with everything, and keep filings unemotional.

Can I get a judge removed from my case?

Rarely. Recusal grounds are narrow, such as a personal or financial interest, not rulings you disagree with. The motion usually goes to that same judge first, so it is high-risk and seldom succeeds.

My ex’s attorney is friends with the judge. Is that a problem?

Usually not by itself. Family bars are small and familiarity is normal rather than corrupt. The real question is whether your own attorney is advocating fully, which you can ask about directly.

Are our attorneys running up bills together?

It happens, though friendship alone is not evidence of it. Ask what your attorney plans to do about a specific problem and why. A vague answer tells you more than the friendship does.
